COMPLETE STEP 5

As a CDL Holder and Owner Operator, completing Steps 1 through 4 with the SAP, the next step in the Return-to-Duty Process is Step 5: the Return-to-Duty drug and/or alcohol test. This test must be arranged through the employer or, when applicable, a C/TPA/TPA; it cannot be completed independently by the employee. Before resuming safety-sensitive duties, the employee must receive a negative Return-to-Duty drug test result and/or an alcohol test result of less than 0.02. Meeting Step 5 does not automatically guarantee reinstatement, as the employer must still decide whether to return the employee to work. For FMCSA drivers, once the negative RTD result is reported to the Clearinghouse, the driver’s status changes from prohibited to not prohibited.
